WHAT PERSONAL INFORMATION DO WE COLLECT?

An online smarTVideo registration or account is required to download, access or purchase certain smarTVideo Services, including the ability to participate in free trials. Information that you provide when registering or creating an account, or accessing or using your account or the smarTVideo Services associated with your account, may include: name and email address; necessary billing information; mobile device number; information concerning software downloaded, products and content purchased, accessed and downloaded through smarTVideo Services; location information (such as zip code or postal code and country); computer configuration (such as operating system, connection speed, and peripherals); the IP Internet (IP) address and URL of the website that sent you to the smarTVideo registration page. Such information collected may include information concerning the types of peripherals (including portable media players), being used by smarTVideo products on your computer or mobile device for the purposes of ensuring that you have access to the latest fixes and patches necessary to enable full compatibility with these devices. We may also ask you for demographic information such as language, gender and age, and, if applicable, content preferences and personalization information.

Children’s Online Information Privacy

We will not knowingly collect, maintain or use personal information in connection with smarTVideo Services (including our web site located at www.smartvideo.com) about children under the age of 13. If a child whom we know to be under age 13 sends personal information to us online, we will not allow that child to use the smarTVideo Services and will only use the information provided to respond directly to that child, notify parents, or seek parental consent, as applicable and subject to the Children’s Online Privacy Protection Act.

HOW DO WE USE YOUR PERSONAL INFORMATION?

smarTVideo™ uses your personal information to:
  • Deliver and bill smarTVideo Services, and communicate with you concerning your account and customer service issues.
  • Verify access rights to content or other access restricted services and software, including for the purpose of supporting digital rights management software.
  • Determine if you meet the minimum system requirements to use our products.
  • Track content accesses and downloads for the purposes of paying royalties and license fees to third party providers.
  • Ask you to participate in surveys about products, services, news and events.
  • Offer you product upgrades, new products and services for you to purchase.
  • Provide you with content, services, instructions, and a more personalized experience based on your language preferences, zip/postal code, country locations, and any content or other preferences you provide.
  • Auto-update downloaded smarTVideo products.
  • Provide you with targeted advertising, promotions, and special offers.
  • Better understand how our products are used, including web traffic patterns and what types of content are most popular with users of our products and services.

Third Party Communication of Personal Information and Choice
smarTVideo does not use your personal information for purposes incompatible with those listed above. Except as otherwise described herein, smarTVideo does not sell, rent, or share your personal information to a third party unless you consent to provide such information to a third party.

smarTVideo may share your personal information with its parent and affiliated companies. In addition, from time-to-time, and unless you provide written notice to us of your desire to “opt-out” (you may provide an opt-out notice at any time to the address set forth at the end of this Privacy Policy, and smarTVideo will comply with such request within thirty (30) days), smarTVideo may share your personal information with joint marketers or other third parties offering targeted advertising, promotions, and special offers, which we reasonably believe may be of interest to you.

smarTVideo also may share with third parties any aggregated data, which is based on your information and/or use but does not personally identify you.

In some cases, access to certain content and service products may require the provision of personal information to smarTVideo's Content providers. In such cases, the personal information you provide as part of your registration for such product will be provided to the Content provider. The Content provider's use of such information is governed by the Content provider's privacy policy, and smarTVideo use is governed by this Privacy Policy. Please review the privacy policy of the Content provider to make sure you understand how they use the personal information you provide to them. If you do not wish for such a transfer to take place, you should not register for the applicable service. Additionally, smarTVideo may be required to provide specific access and usage information to certain content providers and rights holders as a condition of content licensing and royalties. In such cases, smarTVideo may provide content usage, access, demographic and other information without your personally identifiable information (your name, billing information, email address) to the Content provider.

At times, we disclose relevant information about our customers to our contractors in order for them to provide specific services for smarTVideo. smarTVideo's contractors are bound by contractual requirements to keep all information they process strictly confidential and to use such information solely on behalf of smarTVideo. smarTVideo web sites and products contain links to other Web sites and products. smarTVideo is not responsible for the privacy practices or the content of such web sites or products. Obligatory or Optional Nature of the Requested Information
Certain Personal Information you submit to smarTVideo is necessary to provide you with the smarTVideo product or service you choose and to optimize the delivery of audio and video data to your computer or mobile device. smarTVideo offers you the opportunity to disable certain software features to increase your level of privacy. However, certain technical information (e.g., zip code, product id, GUID) may be automatically transmitted between networked servers to optimize your media delivery experience.

E-MAIL FROM SMARTVIDEO
Generally, we send marketing e-mail to you about our products, content and special offers. We may also send you e-mail about products you have previously purchased (such as an available upgrade that you are entitled to receive), your account status, or to inform you about critical technical service issues relating to a smarTVideo product or service.

SECURITY OF PERSONAL AND PAYMENT INFORMATION

smarTVideo maintains the following controls to protect the security of information you provide us, including credit card and billing details collected during the purchase process:
  • Use of secure connections using SSL to safeguard information when transmitted from your Web browser to smarTVideo

CHANGES TO OUR PRIVACY POLICY

smarTVideo reserves the right to update or change this Privacy Policy to keep it up to date with smarTVideo Services and applicable laws. smarTVideo may notify users of the updated Privacy Policy by posting the revised policy in the same location as the prior policy. Your continued access to and/or use of the smarTVideo Services shall constitute your agreement to the revised policy.

NON-US CUSTOMER INFORMATION

If you are a customer who is logging on from outside the United States, the personal information you submit to smarTVideo will be sent to and stored in servers in our U.S. headquarters in Duluth, Georgia. Accordingly, you agree to the application of US laws and further consent to the jurisdiction and venue of the US for the resolution of disputes as set forth in the Terms of Service. The personal information practices set out in this Privacy Policy apply to all of smarTVideo' customers worldwide.

GENERAL

smarTVideo does not guarantee error-free performance under this privacy policy. We will use reasonable efforts to comply with this privacy policy and will take prompt corrective action when we learn of any failure to comply with our privacy policy. This Privacy Policy shall be governed by the laws of state of Georgia, U.S.A. You agree that the terms and conditions of the Terms of Service are hereby incorporated by reference, and that your use of smarTVideo Services is conditioned on your acceptance of those terms and this policy.

smarTVideo may disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on smarTVideo; (b) protect and defend the rights or property of smarTVideo and its products, or (c) act in urgent circumstances to protect the personal safety of users of smarTVideo products or the public at large.

SMARTVIDEO’S LIABILITY, IF ANY, UNDER THIS PRIVACY POLICY SHALL BE LIMITED IN ACCORDANCE WITH THE LIMITATIONS OF LIABILITY SET FORTH IN THE TERMS OF SERVICE.
